Labor Law Alert: Department of Labor Issues Expansions to FMLA Protections

On February 5, the U.S. Department of Labor issued a final rule that expands employee rights under the Family and Medical Leave Act (FMLA).

On February 5, the U.S. Department of Labor issued a final rule that expands employee rights under the Family and Medical Leave Act (FMLA).

The expanded rule provides families of eligible veterans with the same job-protected FMLA leave currently available to families of military service members and enables more military families to take leave for activities that arise when a service member is deployed. It also modifies existing rules so that airline personnel and flight crews are better able to make use of the FMLA’s protections.

The new rule takes effect on March 8, 2013, and affects employers with 50 or more employees and all public sector employers. As a result of the revisions, employers are required to update their mandatory labor law postings with the new FMLA poster by March 8, 2013.
